Competition Terms & Conditions – Winter 2019 John Lewis Competition
This document lays out the Terms and Conditions for Hero Lab’s Winter 2019 Competition, “’Tis the season to be… Soggy?” (the Competition). This document is the master, meaning if it contradicts any of our other materials such as advertising or social posts, this version overrides them. Where we provide instructions for entering the Competition (Entry Instructions) they are also considered part of these Terms and Conditions.
By participating in one of our Competitions, you accept these terms and conditions and agree to abide by them – so please read them carefully and consider retaining a copy for future reference.
The Organiser of this competition is Hero Labs (Hero Laboratories Ltd) of Mercury House, 117 Waterloo Road, London SE1 8UL. (registered in England and Wales, registered company number 11622921).
The prize is also supplied by Hero Labs, unless a third-party supplier (Supplier) is otherwise stated. The prize will be stated alongside the Entry Instructions.
This promotion is open to UK residents (England, Scotland, Wales and Northern Ireland) aged 18 years or over. It’s not open to employees of Hero Labs, or their immediate families or anyone professionally connected with the competition.
Competitions go on for a given time before a winner is chosen (the Entry Window). The Entry Window will normally be stated alongside the Entry Instructions. Hero Labs reserves the right to amend the Entry Window as we see fit, but will not do so unreasonably.
You can enter a competition by following the Entry Instructions. You can only enter once, although there may be tasks you can complete to increase your odds of winning. That means you cannot create multiple email accounts, multiple identities, use software to generate multiple entries or otherwise falsify your entry data. Anyone who does will be disqualified. We can’t accept responsibility for entries that are incomplete, lost due to technical problems, wrongly delivered or otherwise not received.
We will choose the winner or winners of randomly drawn competitions using a random number generator. Skills-based competitions will be judged by our executive team, and possibly by third parties such as a Supplier.
If you are selected as the winner, we will email you using the email address you provided and provide instructions for claiming your prize. If you don’t reply within 14 days, we have the right to choose another winner. You are responsible for checking the contact details you provide and ensuring that they’re current and valid.
Our selection of a winner or winners is final. Prizes can only be accepted by the named winner. We reserve the right to verify winners and ask for proof of identity, age, address, source files for creative submissions, or other evidence relevant to the competition. There is no cash alternative or alternative prize, and prizes are non-transferrable. If for some reason we cannot provide the original prize we have the right to substitute it for one of equal or greater value.
You agree to take part in publicity if you are a winner. That might include us sharing your name, photograph and a statement across social media, our website and other communication channels. We may ask you to provide a quotation or a short interview, in text or by video. By entering the competition you grant us a world-wide, perpetual, irrevocable, non-exclusive, transferable and royalty free licence to use, reproduce, modify, publish or display (in whole or in part) any intellectual property contained in the content of your entry, without royalties or other compensation.
The name and country of the winner(s) can be obtained by sending an email to [email protected] within 28 days of the end of the Entry Window.
We reserve the right to disqualify anyone found to be in breach of these Terms and Conditions, or who has attempted to gain an unfair advantage over other entrants, or has otherwise tampered with the competition in a way we judge to be unfair. Competitions are one of the ways we seek to reward people for following our journey, for promoting us and talking about us on social media, for contributing ideas, opinions or other intellectual property to help guide our product development and ongoing plans. We therefore work hard to make them fair, transparent and fun, and we will strictly penalise participants who seek to upset that balance of fairness.
Entry into the competition is at your own risk, and to the extent permitted by law, Hero Labs does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or third parties arising out of or in connection with the competition and / or accepting a prize. Where a prize is provided by a Supplier, that Supplier is fully responsible for all aspects of the prize including but not limited to the accuracy of its description, its fitness for purpose and fulfilment of the prize itself.
Hero Labs reserves the right to cancel, amend, withdraw, terminate or temporarily suspend the competition in the event of any unforeseen circumstances or technical reason outside of our reasonable control, with no liability to any entrants or Suppliers.
If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses will survive and remain in effect.
The competition itself, these Terms and Conditions, and any disputes arising from them will be subject to English law and the exclusive jurisdiction of the English and Welsh Courts.
Any personal information that entrants share with the Organiser will be kept secure and only used in line with these Terms and Conditions and any marketing from the Organiser and/or the Supplier. By entering the promotion, entrants agree that their information may be used by the Organiser to administer the promotion and winners consent to give their name and county for the winners’ list.
